Your legal requirements in California
What the law actually requires where you are — summarized from our jurisdiction guides. Open any topic for the full details.
California applies Cal/OSHA (Title 8, §3400): no numeric first-aider ratio, but where no infirmary or physician is readily accessible, one or more staff must be adequately trained in first aid.
California childcare licensing (Title 22 §101216 + Health & Safety Code §1596.866) requires at least one staff member trained in pediatric CPR & first aid present at all times; 8 hours, renewed every 2 years.
California's Good Samaritan Law (Health & Safety Code §1799.102) protects any person who, in good faith and not for compensation, renders emergency care at the scene.
The California Board of Registered Nursing makes maintaining competence a condition of licence renewal, and recognized CPR/BLS training supports the nursing standard of care.
California assisted-living settings (RCFE) and adult residential facilities, licensed under Title 22 by the DSS, must keep a CPR-certified staff member on site at all times — day and night — with first-aid and AED capability.
Under California's Resource Family Approval (RFA), at least one caregiver must hold current CPR & first aid covering infants, children and adults before a child is placed — administered by the DSS and county agencies.
Online CPR and first-aid training is recognized in California; Cal/OSHA doesn't prohibit it but recommends hands-on practice (OSHA 3317), so blended with a skills assessment is accepted. 3-year certification.
